TKO Vitality is a telehealth medical weight loss company providing services including Weight Loss (Tirzepatide/Semaglutide), Hormone Replacement Therapy (HRT), Testosterone Replacement Therapy (TRT), and Peptide Therapy.

Not all mobile devices or handsets may be compatible. TKO Vitality is not responsible for messages that are delayed or undelivered due to carrier network issues, device incompatibility, or carrier filtering.

4.9 No Third-Party Marketing Sharing

We do NOT sell, rent, lease, or share your mobile phone number or SMS consent with any third party for their independent marketing purposes. Your phone number is only shared with service providers who are contractually obligated to use it solely for the purpose of delivering messages on our behalf (such as our CRM and messaging platform provider). These service providers are prohibited from using your information for any other purpose.

4.10 Quiet Hours

We comply with federal and state quiet hours regulations. We will not send marketing or promotional text messages before 8:00 AM or after 9:00 PM in your local time zone (or earlier where required by applicable state law, such as 8:00 PM in Florida and Massachusetts). Transactional messages related to active appointments or urgent service matters may be sent outside these hours when reasonably necessary.

We offer financing options through Cherry Technologies, Inc., a buy-now-pay-later (BNPL) provider specializing in healthcare services. If you choose to apply for Cherry financing, your information will be shared with Cherry in accordance with their privacy policy. Cherry's credit determination process is separate from any data enrichment performed by TKO Vitality. Cherry's use of your data is governed by Cherry's Privacy Policy.

10.2 HIPAA Applicability

TKO Vitality's lead generation and marketing activities are NOT governed by the Health Insurance Portability and Accountability Act (HIPAA). HIPAA applies to "covered entities" (healthcare providers who transmit health information electronically in connection with covered transactions, health plans, and healthcare clearinghouses) and their "business associates." TKO Vitality's role in collecting your initial inquiry information and marketing to you does not make us a covered entity under HIPAA.

Once you proceed to a medical consultation with a licensed physician through our telehealth platform, the health information you share during that consultation becomes part of your medical record. That medical record is created and maintained by the licensed physician or medical practice providing your care, and IS subject to HIPAA and applicable state medical privacy laws. 10.4 What We Do and Do Not Send via Text Message

We do NOT send Protected Health Information (PHI), medical diagnoses, lab results, prescription details, or any specific medical information about your treatment via standard unencrypted text message. Text messages from TKO Vitality are limited to appointment reminders (date, time, general purpose), general health and wellness tips (not specific to your personal medical condition), promotional offers and service information, and administrative communications. For medical questions, treatment-specific information, or emergencies, please contact your provider directly through the secure telehealth platform or call 911 for emergencies.
