TKO Vitality is a patient coordination and telehealth facilitation platform. We connect patients with independently licensed healthcare providers who make all clinical and medical decisions, including diagnosis, treatment plans, and prescriptions.
All medical decisions are made solely by licensed physicians and healthcare providers based on their independent clinical judgment. TKO Vitality does not practice medicine, prescribe medications, or provide medical advice.
To use our Services, you must meet all of the following eligibility requirements:
You must be at least eighteen (18) years of age to use our Services, submit information through our forms, or enter into these Terms. By using our Services, you represent and warrant that you are at least 18 years old. If we learn that we have collected personal information from a person under 18, we will delete that information promptly.
You must be a current resident of a U.S. state or territory in which TKO Vitality has licensed and credentialed healthcare providers available. Telehealth regulations vary by state, and our ability to serve you depends on the licensure status of our affiliated providers in your location. It is your responsibility to provide accurate location information.
Medical eligibility for any treatment program is determined solely by the licensed healthcare provider assigned to your case. Meeting the age and geographic requirements above does not guarantee that you will qualify for any specific treatment. The provider may decline to prescribe treatment based on your medical history, current health conditions, existing medications, contraindications, or any other clinical consideration.
We reserve the right, in our sole discretion, to decline, suspend, or terminate service to any individual for any lawful reason, including but not limited to:
When you submit information through our landing pages, forms, or any other part of our Services, you agree to provide true, accurate, current, and complete information. This includes but is not limited to your legal name, email address, phone number, health goals, medical history, and any other information requested during the intake or consultation process.
Providing false or misleading medical information can result in inappropriate treatment recommendations and may endanger your health. You understand and acknowledge that the accuracy of information you provide directly impacts the quality and safety of the medical care you receive.
You are solely responsible for all information you submit through our Services. You agree to promptly update any information that changes after submission. You are responsible for maintaining the confidentiality of any login credentials, patient portal access, or account information provided to you.
Each individual is permitted to submit one (1) inquiry or lead form per service offering. Duplicate submissions, submitting information on behalf of another person without their explicit authorization, or creating multiple inquiries to circumvent our processes is prohibited and may result in the cancellation of all associated inquiries.
IMPORTANT: Please read this section carefully. It describes your rights and obligations regarding text messages from TKO Vitality, and it constitutes a part of your agreement with us under the Telephone Consumer Protection Act (TCPA) and related regulations.

TKO Vitality is not responsible for any charges imposed by your wireless carrier. Please contact your carrier for details about your messaging plan and any applicable fees.
You may opt out of receiving text messages at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any text message you receive from us. Upon receipt of your opt-out request, we will send you a single confirmation message to acknowledge that you have been unsubscribed. After opting out, you will no longer receive promotional or marketing text messages from TKO Vitality. Please note that transactional messages directly related to active medical services (e.g., critical medication notifications) may continue to be sent as required by law or for your safety, unless you specifically request otherwise.

Wireless carriers, including but not limited to T-Mobile, AT&T, Verizon, Sprint, U.S. Cellular, and other major and regional carriers, are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and is outside the control of TKO Vitality. We cannot guarantee that messages will be delivered or delivered in a timely manner, and we shall not be liable for any delays or failures in message delivery.
Your consent to receive text messages is specific to TKO Vitality and its authorized service providers only. We will not sell, rent, lease, or share your phone number or SMS consent with third parties for their independent marketing purposes. Your phone number may be shared with our technology and service providers (such as our CRM and messaging platforms) solely for the purpose of delivering messages on our behalf in connection with the Services you have requested.
Our text messaging services are compatible with most major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Cricket, MetroPCS, Boost Mobile, Virgin Mobile, and other participating carriers. If your carrier does not support the type of messaging we send, you may not receive all messages. T-Mobile is not liable for delayed or undelivered messages.
When you provide your consent to receive text messages, we record and retain the following information: the date and time of consent, the phone number provided, the specific form or page on which consent was given, your IP address, and the specific consent language displayed at the time of opt-in. These records are maintained as evidence of your consent in compliance with TCPA and applicable state regulations.

This process is used solely to ensure the accuracy of your information and to match you with appropriate service programs.
This data enrichment process is NOT a credit check, does NOT affect your credit score, and does NOT involve accessing your credit report. It is a standard data validation practice used to improve service delivery and prevent fraud.

TELEHEALTH SERVICES ARE NOT A SUBSTITUTE FOR EMERGENCY MEDICAL CARE. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not rely on telehealth services for emergencies, acute conditions, or situations requiring immediate in-person medical attention.
Individual results from any treatment program, including weight loss programs using Tirzepatide or Semaglutide, hormone replacement therapy, testosterone replacement therapy, or peptide therapy, vary significantly from person to person. We do not guarantee any specific outcomes, results, weight loss amounts, or timeframes. Results depend on numerous factors including but not limited to your individual physiology, adherence to treatment protocols, diet, exercise, lifestyle choices, pre-existing medical conditions, and other variables outside our control.

All medications are prescribed at the sole discretion of the licensed healthcare provider based on their independent clinical evaluation of your health, medical history, and suitability for treatment. All medical treatments, including those offered through our platform, carry potential risks and side effects. Your healthcare provider is responsible for disclosing known side effects, risks, and contraindications during your consultation. It is your responsibility to:
You acknowledge that telehealth consultations have inherent limitations compared to in-person medical examinations. Certain conditions may require in-person evaluation, physical examination, or laboratory testing that cannot be performed remotely. Your provider may refer you to an in-person healthcare provider if they determine that telehealth is insufficient for your needs.
TKO Vitality may offer financing options to help patients manage the cost of treatment programs. Any financing offered through our platform is provided by independent third-party financing companies.
Patient financing is currently available through Cherry Technologies, Inc. ("Cherry") and may be expanded to include other financing providers in the future. Cherry is an independent third-party "buy now, pay later" (BNPL) service and is not owned, controlled, or operated by TKO Vitality.
TKO Vitality LLC is not a lender, financial institution, bank, or credit provider. We do not make loans, extend credit, collect debt on financing agreements, or make credit decisions. We simply offer financing as a payment convenience through third-party providers. All financing decisions, including approval, interest rates, repayment terms, fees, and collection activities, are made exclusively by the third-party financing provider.
All content, materials, and intellectual property available on or through our Services, including but not limited to text, graphics, logos, images, photographs, video content, audio content, illustrations, icons, software, code, page layout, design elements, trademarks, trade names, service marks, and the overall "look and feel" of our websites and marketing materials, are the exclusive property of TKO Vitality LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property and proprietary rights laws.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TKO VITALITY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall TKO Vitality's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of our Services exceed the greater of: (a) the total amount you paid to TKO Vitality in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).
Nothing in these Terms shall be construed to limit or waive any claims for medical malpractice against a licensed healthcare provider. Medical malpractice claims are governed by the laws of the applicable state in which the provider is licensed and the patient resides. TKO Vitality, as a non-medical service platform, is not liable for the clinical decisions, diagnoses, prescriptions, or medical judgment of independently licensed healthcare providers who provide services through our platform.
We are not liable for any acts, omissions, failures, or negligence of third parties, including but not limited to healthcare providers, pharmacies, medication manufacturers, shipping carriers, payment processors, or financing providers.
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions or orders, supply chain disruptions, internet or telecommunications failures, or labor disputes.
You agree to indemnify, defend, and hold harmless TKO Vitality LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees and court costs) arising out of or in connection with:

These Terms and any disputes arising out of or relating to these Terms, your use of our Services, or the relationship between you and TKO Vitality shall be governed by and construed in accordance with the laws of the State in which TKO Vitality LLC is organized, without regard to its conflict of law principles.
You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the jurisdiction where TKO Vitality LLC maintains its principal place of business, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.
To the extent that any applicable state or federal law conflicts with these Terms, the applicable law shall govern to the extent of such conflict, and the remaining provisions of these Terms shall remain in full force and effect.
Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our Services informally by contacting us at support@tkovitality.co. We will attempt to resolve the dispute informally by contacting you via email or phone. If a dispute is not resolved within sixty (60) days of the date you first contact us, you or TKO Vitality may then proceed to binding arbitration as set forth below.
Any dispute, claim, or controversy arising out of or relating to these Terms, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator, and the seat of arbitration shall be in the jurisdiction where TKO Vitality LLC maintains its principal place of business. Judgment on the arbitration award may be entered in any court having competent jurisdiction.
The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could award, including injunctive or declaratory relief. The arbitrator's award shall be final and binding on all parties.
Each party shall bear its own costs and attorneys' fees in connection with the arbitration, unless the arbitrator determines that a different allocation is appropriate under applicable law.
YOU AND TKO VITALITY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. Unless both you and TKO Vitality agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative, class, or consolidated proceeding.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights. Additionally, claims of medical malpractice against licensed healthcare providers are not subject to this arbitration provision and shall be governed by applicable state law.
You may opt out of the arbitration and class action waiver provisions above by sending written notice of your decision to opt out to support@tkovitality.co within thirty (30) days of first accepting these Terms. Your notice must include your full legal name, mailing address, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, neither you nor TKO Vitality will be required to arbitrate disputes, and all disputes will be resolved in court as set forth in the Governing Law section above.
TKO Vitality reserves the right to modify, amend, update, or replace these Terms at any time, in our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. We may also, at our discretion, notify you of material changes through email, SMS (if you have opted in), or a prominent notice on our website.
Your continued use of our Services after the posting of any changes to these Terms constitutes your acceptance of those changes. If you do not agree with any modifications, you must discontinue use of our Services immediately.
It is your responsibility to review these Terms periodically for changes. Material changes will be effective immediately upon posting unless otherwise stated. Non-material changes or clarifications will take effect immediately.

The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of that provision in any other jurisdiction.
If any provision of these Terms is found to be unenforceable, the parties agree that the court or arbitrator should endeavor to give effect to the parties' intentions as reflected in the provision, and the remaining provisions of these Terms shall remain in full force and effect.
These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and TKO Vitality with respect to your use of our Services and supersede all prior or contemporaneous communications, proposals, representations, and agreements, whether oral or written.
The failure of TKO Vitality to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by TKO Vitality.
You may not assign or transfer these Terms, by operation of law or otherwise, without TKO Vitality's prior written consent. TKO Vitality may assign or transfer these Terms, in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of our assets.
Nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between you and TKO Vitality. Healthcare providers who provide medical services through our platform are independent practitioners and are not employees or agents of TKO Vitality.
By using our Services, you consent to receive electronic communications from us (via email, SMS if opted in, or through notices posted on our website). You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
